    actually it was about a landbased casino:

    “Holland refused to license CFR to organise a casino in a dutch town”

    There is something about this in the latest CAP magazine, p38 – Here is the section on Sweden – I am not an expert so can’t answer questions – The guy that wrote it is Tom Russell a lawayer from Berwin leighton Paisner:

    “In Sweden, in the absence of local presence of operators, enforcement action has focused on advertising intermediaries and the Swedish Gaming Board has acted a number of times against the promotion in Sweden of gambling arranged abroad. One of the cases concerned a banner on a website owned and operated by a Swedish private person containing an advertisement for, and a link to, a London based online gaming company. Criminal proceedings have also been brought against the representatives of Swedish newspapers for their printing and distribution of advertisements for foreign online gaming companies. The Swedish Gaming Board has held that the insertion of such advertisement constitutes illegal promotion of lotteries arranged abroard.
    However, in all cases no entity outside Sweden has been pursued, so ironically the operator has not been targeted.”

    The article concludes:

    “There is a patchwork approach to marketing gambling services in the EU, with little consistency or clarity in laws. As such what may be tolerated today may be prosecuted tomorrow and visa versa. The most important advice is to monitor the situation carefully and try to ensure one’s activities are not high profile and flying onto the radar of local prosecutors”

    As far as i know swedish ppl are not allowed to run lotteries and casinos. Only the gov in sweden are allowed to do it.

    You are not allowed to market casinos in other coutries to swedish citicens.

    But i think you are allowed to work as an affiliate and send ppl from other nations to online casinos. I can’t see that the lottery inspection can’t say anything about that.

    As far as I understand it it’s the same sort of problem in Norway as well, but as long as you don’t use a country domain like .no .se or .dk then you should be alright, failing that move the company, hosting etc offshore and failing that leave the country!! ;-)

    Are you sure you dont mean threat of “vite”?

    They arent even suing our biggest daily newspapers who are definitively Swedish registered companies with online and offline presence and have been running ads for Betting, Poker and Gambling for years.

    They have however been charging them this “vite” penalty which when you look at a full page ad bumps the total price from 450,000 SEK to 600,000 SEK so essentially is a 33% increase in ad fees really. This is what I’ve heard at least and may be somewhat unupdated information also.

    Essentially what the current swedish lottery regulation says is that you cannot promote lotteries. It also clarifies that poker is a game of chance and therefore is equal to a lottery.

    If you do, you can be fined with the so called “vite” which is a standard amount with a certain range but primarily serves as a threat of “either you close down within 2 weeks of receiving our written notice or else”.

    I personally wouldnt risk trying to defend myself and take it to the EU for decision but that’s me.

    I’d comply with their demands and try to find a way around them. Consult a lawyer who has knowledge in these matters.

    Could you give us some more details though? I am very curious about what they wrote? Any chance you can scan the document? Also whats your website’s URL?

    As far as advertising is concerned I believe you can advertise freerolls etc, but as soon as you mention money and or your advertising is seen as enticing people to spend money and gamble you then step over the line. With this in mind there are loopholes in the law which you can work around.

    We will be running a poker tournament in Sweden this summer, but because there is no cash involved (freeroll with a trip to China to be won), then we have avoided any problems with the law.

    Perhaps these newspapers mentioned by Rakemeback have avoided attention from the law by publishing material which has no mention of money?
