    I noticed this in the t&c’s at Starluck

    4.9 Negative Net Revenue: In the event that the Net Revenue quotient is a negative amount during any given period(s), such negative amount shall be carried forward and deducted from the Net Revenue amount of the relevant subsequent period of time. In the event that the Net Revenue quotient is a negative amount for three (3) consecutive calendar months, we shall be entitled to terminate this Agreement.

    and

    5.3 Termination By Us. We may terminate this Agreement, with or without cause, upon thirty (30) days written notice to you. Further, we may terminate this Agreement immediately, without notice, in the following events:
    a. You materially breach this Agreement and do not cure within fifteen (15) days of notice to cure;
    b. The total cumulative balance of Affiliate Fees due to you is less than $50 for three (3) consecutive months;
    c. We determine, in our reasonable discretion, that you knowingly benefited from Fraud Traffic as set forth in Section 2.8 herein; and
    d. The total number of new Players introduced by you in a sixty (60) day period is less than 1.

    So.. if I send you a player who hits a massive jackpot – that means that this has to be remedied within 3 months? What if the player hits for example 50K and he/she is not a player that immediately plays it all back…. That would put me 15k in the hole at the 30% rate. So, for me to be able to keep promoting you, it would mean that I would need to earn 5k a month for three months (plus $50 in the last month) ? Not that this is a very difficult task to achieve, I would need to pray that nobody wins anything on the way as well.

    Tell me if I understood that wrong…

    Also.. this scenario:

    d. The total number of new Players introduced by you in a sixty (60) day period is less than 1.

    Certainly that does not mean that the players that I sent prior to the 60 days (where none were sent) suddenly become null and void, does it?

    If I do not send you a player for 60 days, you feel you can terminate the contract, which means I lose any players that I have sent you in the past.. that does not mean FOR THE LIFE OF EVERY PLAYER.

    Kelvin, you have been working with us since a long time now and I hope this is not the first time you have seen our affiliate agreement.

    This is our standard affiliate agreement and is valid for all our brands. :)

    To answer to your question – there are other ways of an affiliate account getting negative apart from a player win. Players take advantage of the casino which results in a negative balance for both the affiliate and the casino. And at times affiliates and players conduct fraud in collusion. Terms and Conditions are set to avoid frauds and protect the rights of the company against any fraudulent activities. Your interpretation of the terms is fairly accurate from the legal point of view. However, I have never seen this clause being implemented till date.

    If one of your players hits a big jackpot, logically there is no reason to block your account, coz you are performing your act in the partnership, in getting the players. Getting winning players is not an act of fraud. Therefore your account stays active.

    Also have a look at clause 5.4 (d).

    PS. As Affiliate Managers it’s our responsibility to protect the rights of our affiliates. This is true for affiliates who get us 2000 sign ups or 2 sign ups or the affiliates who try hard and end up getting no sign ups in a month. Everyone get more or less the same treatment as long as they refrain from committing any kind of fraud.

    Party Poker placed a hold on my account. Granted, I am not a productive partner, but I hate being made to feel like I did something criminal.

    I contacted iglobalmedia 3 different times and the only thing stated was that Party wanted to see if any of my referrals were going to be real players or not. I do have a very small negative balance, but I don’t remember for how long.

    I have just sent another email today to ask if I am terminated. Is there a standard “on hold” period before I receive some type of decision?

    I am not sure how often Satya will be able to check in here – he is travelling and will not be settled again until after the CAC conference in April.

    I suggest you talk to your account manager for the time being….and possibly Satya will check in but likely he will not be able to deal with things in the same timely manner we are used to.
