Now, I really really REALLY do not want to take a ride in a police car… or spend one hour in a holding cell… heck, I don’t even wanna get one of those cool mug shot photos taken (although if I do, I will put then on t-shirts and sell them at CAC in Vegas)! But it’s so nice to know that I won’t have to fight this alone!Right now, I am rushing to speak with several attorneys. If it becomes clear that I WILL BE ARRESTED if I stay here, I will do my best to get out of harms way. But, if it seems I am safe from prosecution, I will stay and see what happens.
Can you explain how they can put you in jail if the law is not yet permanent.

The law IS permanent. It’s been on the books since 1973, and was recently updated to include the internet. At the same time, they bumped the severity from a gross misdemeanor to a class three felony… with up to 5 years in state prison.
May 31, 2006 at 5:50 pm #693873AnonymousInactiveCorrect me if I’m wrong but, I don’t understand why the “fund” can’t be entrusted to an escrow. Wouldn’t it be better to buy “lawyer insurance” than wait for the event to happen? It’s like getting an oil change… before your engine seizes up.
Also, why couldn’t it extend to others? From what I’ve been reading, only J is getting a fund IF something happens. Why can’t this fund be accessed by anybody who’s being made an example of?

P.S. I’ve been in jail for a weekend once (165 MPH on the freeway, nothing “criminal”) and let me just say, it’s not a very fun place to be. The people who are in there are IDIOTS, scum of all scum. I grabbed a deck of cards and tried to play holdem with them, but none of them were smart enough to even learn hand rankings. Instead, we played War.

For the record, my grand goes to whoever is involved in a deciding case be it J. Todd or any other webmaster. Not anyone specific.

I asked for support because I am the one most in immediate danger. There is at least one other webmaster in this state, and I am certain that if he got arrested — or we take a fall together — that the funds would open up all over the gambling community.
Let me say that I will plegde $1,000 to the legal funds of any other webmaster arrested for this cause… and if I am arrested, I fully expect to pay a majority of the fees out of my own pocket.
The APCW is considering Bernie’s superb idea of a legal fund for all webmaster members. Getting it set-up and going will take work, but we can do this one step at a time.

I spoke with a reporter for a major Washington newspaper doing a story on this new law. He stated that he interviewed the State Gambling Commission Director about his statement to go after “promoters” in Washington State.
What this reporter told me was that I, J.Todd, am “…already in the crosshairs…” of the commission.
There’s no doubt anymore…
May 31, 2006 at 9:52 pm #693901AnonymousInactiveI emailed the ACLU and pointed them towards this thread yesterday after I first read the post, I don’t know their point of view regarding gambling, but IMO their is more than gambling being discussed in this thread.. it’s my home.. thats the part that really gets me.. someone is trying to tell me what I can do in my house.. I could see if they were telling me not to beat my kids, someone needs to protect kids when parents don’t.. same deal for child porn.. someone needs to protect those kids to.. but frankly if I want to sit here and squander my life savings thats my business..
I LOVE the escrow idea.. it would also give ppl like me, a chance to donate enough to make a difference before it matters and it would open this up to all of the webmasters in Washington that stand up for their rights.. so that this law doesn’t spread throughout the rest of the 50 states .. Can’t keep up with you big boys yet
I also encourage all of you to send emails to your senators, again if you already did.. get out a pen and paper too, write them a letter.. Send a quick email to the ACLU too, http://www.aclu.com

I appreciate the continued support from you guys on this. I have an appointment on Friday to speak with two gaming attornies in Washington. That will be my decisive moment.
They want a $5,000 deposit, which I plan to cover in full myself before asking for any back-up from my friends. I hope that, after Friday, I see a way to get through all of this… but as of now, I am planning on having all my websites down the night of the 6th.
And to add EVEN MORE ABSURDITY to this issue, today Washington State legalized some forms of “illegal internet gambling” on horse racing! Guess what? All they wanted was the money!

Before they prosecute you, though, I think they will serve you with a cease and desist order. Basically it says, we’ve made what you are doing illegal and now you have to stop or we will prosecute. (I don’t think they will try to prosecute you for doing it before the law was a law but you never know.) At which point you stall for time and ask them to clarify it and act dummer than dirt. They will respond by talking legalize to impress you and you may then act shocked and awestricken and apologize and say you didn’t know about the law and oh gosh I’ll quit right away, while you move yourself and family out of harms’ way.
The best way to fight this is from the place known as absentia, so if it goes pear shaped the worst that will happen is you know you can’t go back to Washington again, or perhaps any state that would turn you over to Washington.
