While I understand the want to protect yourself you are not in the right here. You sent me a letter saying you would pay me but to “watch out” as my players were winning or bonus playing…
… You need to have some guidelines in writing. It is not right to just arbitrarily decide that you don’t want to pay for a month if you did not make enough of a profit or you should totally do away with cpa. Cpa is a risk that both sides take – it is unfair to try this retroactive approach. I am sure some very honest affiliates are suffering because of this.
You really need to have something in writing and not just an arbitrary non payment. You did pay me but if you would not have I would have been enraged and it would have basically been a theft on your part.
