Same thing we did about the T&C breach of contract last year – EVERY program decided to do the right thing, even if it took a couple months for the pressure to work.

We can NOT let this happen, even once.

Empire AND Party made a deal without taking affiliates into consideration.

    They are BOTH at fault.

If anyone owes you anything it’s Empire. Your contract was through them. If they didnt insist that players be transfered(or affiliates be compensated) when the takeover took place, so be it. Empire obviously wasn’t looking out for its affiliates. This is going to become common place in the future. This is one of the main reasons programs are doing away with their CPA programs. As the smaller sites get bought out you’ll lose players from there. It sucks, but what can be done about it? Really?

Let’s say I’m interested in buying all of your affiliate websites. I get in touch with you and ask you what you want for everything. You tell me $20.

I tell you that I really don’t feel like paying that much, that I’ll pay you $5 instead, and if you refuse, I’ll launch a DOS attack on all of your websites and render them useless.

    You refuse.

I shut your websites down for a week. You threaten to sue me. I laugh. Your websites are down for another week. You try every means to continue to operate your business but you can’t. You still make money but you’re not acquiring any new players so your long term prospects are bleak, and getting bleaker.

I contact you again and offer $3 this time. You agree, but with the stipulation that you get 20% of the recurring revenue from all of the players you’ve already acquired.

I laugh in your face. Your websites continue to stay dark. After another month or so I again offer you $3 for everything, you finally give in, and agree.

This is obviously a loaded, completely hypothetical scenario, but it’s not hard to find parallels. Empire isn’t at fault here. They were never in a position to negotiate anything, on either their behalf or on behalf of their affiliates. They got kneecapped and salvaged what they could.

From a cut-throat business perspective, I admire what Party has done. They’re using their bulk to maximum effect. They’re vigorously attacking and eliminating costs from their business structure, first going after licensees and then affiliates. They needed both licensees and affiliates to grow, in the early stages, but now they’re a drag on profits.

I’m not even saying that people shouldn’t be an affiilate of PartyGaming. Plenty of people are currently making beaucoup dollars, doing just that, and likely will for quite awhile.

All I’m saying is that if you do so, abandon all hope that they have the interests of affiliates in mind. Because they don’t. At all. You should be prepared for any dollar you make through their program to disappear tomorrow, with no warning, because it very well could.

    Recieved this from Empire today:

    “Your concern is our responsibility.
We are still in the process of sorting out a lot of issues but I would like
you to know that we will make some kind of arrangement for our affiliates
on the revenue share deal. We are checking for all possible solutions.

Once a solution is reached I will personally send you an email and inform
    you of the same.
    Best Regards

First I would like to send shot outs to Dominique and the rest who are willing to take action.

I can’t say anything that haven’t been said already. I have spoken to our AM and she told me that a solution will be found. Until then I hope and trust that this will happen.

If it doesn’t we will like the most people in here support the BLOCK of these companys and also tell our partners/sub-suppliers to do the same.

One guy said in this threat that this is why CPA is a good model – damn straight! 😡

Ok, I never thought I would say this:

    CPA is a good alternative.

If you have to promote a program you can’t trust further than you can throw it.

I am not even remotely shocked at Party’s behavior and attitude. As to those “lifetime” players we work so hard for – Party doesn’t honor that in the first place. They have still never resolved the disappearance of my regular players that I earned over the past 4 years with Starluck. My earnings went from thousands a month to a couple of hundred after this last fiasco when the affiliate area was down, and thats because I had 3 new signups this month. Wonder how long I’ll get to keep them before they disappear with the next software upgrade. I imagine they hope I’ll just forget it and go away.

Little you can do, except making sure everone you know knows about it, and everyone they know knows about it, and so on and so on.

    That does work.

I don’t believe that Empire is not getting it’s due share of the blame. Empire made a deal without taking consideration (legally) of the affiliates that helped build their Empire business. To say Empire is without blame is totally incorrect. They are one of the 2 parties to this deal and they received $250M which should take into consideration the purchase of the players. I believe that Empire should be paying affiliates (like InterTops) a fixed fee as a compensation for the loss of revenue.

Eg. This should be equal to the:

% deal agreed with affiliates x (the money they received from Party on a player value basis). Eg. if the player value is $3000 and you get 30% they should pay you 30% = $1000 for each player affiliates ever sent.

My calculation is that they got $250M for say 80,000 players. Each player was bought for $3125.00 . If you have a 30% deal you own 30% of the player and Empire, not Party, should be paying $937.50 for each player sent.

There is something that can be done: Since I believe Empire is more at fault, affiliates should abandon all Empire properties including ClubDice etc. These guys are as much to blame as anybody and as they hold the money they should do what InterTops did when they lost their skin and that is to pay the affiliates.

Empire has shown up twice since this happened and posted that they will take care of this as best they can.

It also looks like Party is going to come out and talk to us once the deal is completely finalized.

We’ll see, maybe this can still be fixed.

This is also not just about poker. There are casinos involved too, and I for one am most unhappy to have lost a player I have had for literally years. That player is the type of player I work for, what I strive to find. Thank god it was only one.

Letter from Tradal posted in thier system (see below)

Looks like the first sign of a potential settlement in favour of the affiliates.
Props to those affiliates who stepped up to put pressure regarding this situation. I hope those affiliates who have a large number of Empire players now feel a bit comfortable regarding this negative impact situation.

I hope this proves that the affiliate community when we stick together is a very powerful force than if we act on these type of situations alone. It is clear that the affiliate pressure on both parties in this transaction had enough impact to get a satisfactory resolution.

I agree with everyone posting here that as the consolidation of the online gaming industry escalates and the traditional land-based casinos enter the online space (bound to happen) these kind of threats will become more prevalent. The affiliate community when we act together is a VERY powerful force to the income potential of these online properties.

Kudos who took an active stance in this process.

    Jamie
