February 22, 2006 at 5:55 am #684352AnonymousInactiveApologies for the limited feedback on this matter. We have tried on numerous occassions, both via e-mail and telephone, to contact the Affiliate, however with no success.
We will continue to try establish contact to discuss this urgent matter. Please note that Wayne is currently on vacation with his family returning back to work at the end of next week.
Thanks
Leith

At this point, I would simply shut down his account and end the partnership. What alternative is there? Unethical behavior shouldn’t be tolerated, and Referback’s lack of swift action only serves to show other unethical affiliates that they can get away with this type of thing for a long time….I am having an issue of my own, and I would appreciate it if you could look into it. Here is the thread where I described the problem.
Thanks.

From my stand point I beleive Holis has been very patient in this matter. This matter should have been settled in a week not months. I would like to see the matter persued further and all income earned by these So called affiliates turned over to Holis.
Holis is the one who did all the hard work afterall. But in any case, trying to contact these affiliates in question is the wrong approach and rarely works.. What you do is take the aff tags which Holis provided go into their account and give all earnings to Holis.

and I in turn would donate it all to katrina relief or some other deserving charity.
February 23, 2006 at 11:51 am #684513AnonymousInactiveWho cares if you hear from them? How flimsy is that! It’s been more than a month, they’ve had ample time to get back to you! Take care of the affiliate that is playing by the rules.. Seems like pretty simple stuff to me
February 26, 2006 at 7:32 pm #684751AnonymousInactiveHolis, I have taken care of some of your concerns. There are however more than what I thought. I wonder why Wayne hasn’t responded? The site below is a redirect as well. I have several others, it starting to look like another 888.com and cpays issue. In house servers on these, strange? greek39

This is my first day back from my vacation. The reason why the account was not closed earlier is that this is a third party issue between two web masters. I have closed the account to force contact from the affiliate, with the purpose to inform the person of the dispute.
We cannot withhold revenue from the affiliate as he has not breached the terms and conditions of ReferBack. We will do all we can to help settle the dispute, however we have to abide by terms and conditions and the privacy agreements. ReferBack will continue to do all it can to discourage this type of behavior.
Please let me know if there are any further questions.
Cheers,

Drawdead.com is the best online poker site on the internet for poker freerolls,

XXXXantczak.netserve.info/ – Similar pagesIn case you did not give it a second glance, that’s Holis’s site in the description. The page redirects to Referback. Seeing its okay and there are no problems maybe I will scrape your site.
Based on what you are saying, scraping other affiliates sites is okay? I am little confused. Some of these sites have been takin care of because according to all Major search engine this sort of thing is against there policies.
What should I tell them Wayne? Referback endorses this behavior? The monies earned belongs to Holis it was his work that brought you the earnings. greek39
March 7, 2006 at 6:47 am #685545AnonymousInactiveHi greek39,
ReferBack does not support this kind of behavior, that’s not what I said. We are doing all we can to stop this kind of behavior and in this case the web master has contacted us and has/will remove the content. The problem here is that we cannot control/monitor every affiliate that joins ReferBack.
If another party were to scrape the ReferBack site the responsibility would ours to resolve the issue. In this case the dispute is between Holis and another web master, not ReferBack, which negates our terms and conditions.
As we do not allow this kind of behavior we do facilitate a resolution, which in this case was favorable.
Cheers,

March 7, 2006 at 2:04 pm #685567AnonymousInactiveHolis,
Do what I do if you do not get a response from webmasters who are all too content to steal your hard work. Phone them up if you can get their phone number. This usually does the trick!
If their phone number isn’t listed in their whois record and the whois record is incomplete or wrong, file a invalid whois report with ICANN – They do take action.
Failing that, file a DMCA report against the site in question and/or take legal action.
