“Zane is the “authority” at Referback”
Zane do everyone a favor – either listen to Spearmaster or get a different job………
August 23, 2005 at 8:04 pm #671509AnonymousInactiveAs far as I am concerned there is only one way to solve this small problem of yours and then i doubt it will be enough.
Offer a flat 35% commission to all affiliates, and a 40% commission for affiliates that deliver. The above commission is considered common in this industry. On top of that offer the same terms and conditions that everyone else has.
Now that we took the time to remove your properties and took the time to replace them with casinos that actually pay the above amount, there is no way that we will bother taking the time to update our websites for any referback casino.
If you think we are all going to jump back on because one of many unsatisfactory clauses was removed good luck.
Seriously, go to any search engine, it used to be that out of the top 10 websites in any search engine, 9 featured referback, now you would be lucky to find referback buried in an inner page in 1 or 2 of those websites. Please acknowledge this and then give me an honest answer as to why that is.
Not only do your casinos convert worth a damn and have horrible player value, but now you are also stealing from us.

I agree 100%.. I have taken the time to remove them as well.. I am sure not going to be putting them back up on my sites just because they changed a few things.
It is nice to see other casinos converting well in the spots referback had held.
I will not be filling out some poll. Can’t trust the poll results anyways, since RB can make them come out anyways that they want..
August 23, 2005 at 8:53 pm #671513AnonymousInactiveA little legal talk:
We as affiliates earn commissions from the players that we refer to these casinos. This is commonly and clearly defined as having a “vested interest” in these players which have been delivered.
Contract law, in every instance I have found so far, protects your vested interest against the unilateral retroactive application of any new conditions introduced insofar as they have a detrimental or negative affect on your vested interest.
I don’t care what country we’re talking about (except maybe Munchkinland) – I am absolutely certain that any such unilateral retroactive application against a vested interest will fail in a court of law, unless they can find a way to prove that your vested interest really isn’t a vested interest.
Sharing revenue over the lifetime of the player is about a clear a definition of “vested interest” as can possibly be made with respect to gambling. This is basically the equivalent of an insurance agent collecting a percentage of the premiums which are paid by his/her clients every year. That is also clearly defined as “vested interest”.
Now you want to ask that of your lawyers, Zane? The minute your legal team hears the words “vested interest” they will look for the nearest rock to crawl under.
We might want to mention this elsewhere in case any other program wants to even CONSIDER playing with the calculation of commissions – and this would also serve as a good reminder to certain other programs which have yet to revert to a status which does not breach the contracts they made with their affiliates.

August 25, 2005 at 10:17 am #671679AnonymousInactiveHi Zane, Judith, Wayne, Cobus and everyone else!
We need an answer of some sort by close of business your time today. That answer should either promote a new solution, or else revert back to your original terms, albeit temporarily, until such time as you are ready to announce a new solution which is acceptable to all parties.
Referback needs to be operating from a legal perspective – as opposed to one likely to be found to wrongfully impact the benefits of the vested interest affiliates have in the players they send to you.
It would pain me, and I’m sure many others, if Referback cannot realize this by at least moving back to the white side of the equation for the time being. But I fully intend to move forward tonight as everyone is one week past their original stated deadline.
Please, please, for everyone’s sake – do the right thing today.
August 25, 2005 at 4:18 pm #671695AnonymousInactiveHello Zane and all,
I think you are not seeing the big picture at all.
This is NOT about who makes what money and how.
It is about integrity, about the validity of contracts, about the ability to trust a handshake. It is about decency.
It doesn’t matter how you change the payment rules around – if they are not what each of us signed for you are in breach of contract. You are injuring the integrity of the industry. You have broken people’s goodwill and trust.
I am not sure you guys are realizing how very serious this is – it’s not a handful of irate affs on message boards flaming you.
Your sucess and acceptance in this industry is very much at stake.
Affiliates are not helpless as you may think, we do rule the SERPS. We do have direct influence on players.
And loyalty – where is yours?
Please do the right thing and honor the contracts we closed with you in good faith. THEN we talk about deals.
