I have been waiting for your response to sipka’s findings {Thanks sipka} on the agreement at 5.1?

I am just reviewing your TC and found a point I don’t really understand:5.1. This Agreement is in effect for a period of one (1) year (the “Term”) with additional one (1) year extensions at Affiliate Arena partner’s option. If Affiliate Arena partner elects to exercise this option, the option as exercised must be addressed to Affiliate Arena in writing, no later than forty five (45) days prior to the expiration of the Term. The expiration notifications should be sent in writing, at least thirty (30) days prior to the expiration of the term.
What does it exactly mean? If the agreement ends in 1 year, then our players don’t belong to us for life?” end Quote.
If that is the case of only retaining that customer for 1 year, than why would anyone want to choose Rev Share? Might as well choose CPA if we lose the customer a year after 1st deposit.January 3, 2009 at 10:06 pm #791512ghurjhanMemberThose are some interesting T&C’s – I’ve never once heard of any affiliate program basically “leasing” any new players that affiliates bring in :sarcasm:

Please note this term DOES NOT mean you lose your players after a year. It was meant only to give the full option to partners to leave the program if they so wish and they could communicate with us as to how to properly have details etc removed. It does seem on reflection that the terms need a review and need some refining. I will make sure this is done. I can clarify fully now that affiliates DO NOT lose any players after 1 year but i will make sure this is clarified and refined in the terms so there can be no misunderstanding- my apologies for any inconvenience caused.

I think the main point here was :”This Agreement is in effect for a period of one (1) year ” – as this means the contract between affiliates and you is only for an exact period (one year), and it seems it needs some rephrasing.As soon as it is done, I will be the first to sign up as I like your bingo halls very much

Yeah it seems there has been some justified confusion here- it was not meant to be any type of ‘leasing’ or ‘player removal’ after a year period it was purely meant to be a correct ‘contract’ type allowing the appropriate measures to be considered if an affilaite decided to formally leave the partnership. I can see it has brought some confusion and worries and i will gladly change this to remove misunderstanding.

Article 5.1 has been rephrased for better clairty- affiliates DO NOT lose anything after a year or ‘Lease’ — once a player comes through affiliates have ownership of them with us. The below is just a correct termination of agreement clause.
I hope the below is better and provides clarification.

5.1 This Agreement shall commence and be deemed effective on the date when accepted by an authorized representative of the Affiliate Arena partner (the “Effective Date”). This Agreement shall be deemed to be accepted by the Affiliate Arena partner when the Affiliate Arena partner chooses “YES” to the “Affiliate Arena WAGERING AND GAMING PARTNERS AGREEMENT” and hits the submit button on the Affiliate Arena partner Sign-Up page. An Affiliate Arena partner is free to terminate the agreement; if a partner wishes to exercise this option then this must be addressed in writing with 30 days notice.
