Hello everybody, I’m an Australian affiliate who’s been thinking of getting into promoting casinos and poker.
I’ll make this quick. I was of the understanding that since the 2001 Interactive Gambling Act came to be, that it is illegal for Australians to “advertise” online casinos and real money poker sites.
My question is, is it or is it not illegal for an Australian resident to promote online casinos to Australians?
I have emailed several people and also sent a message to CentreBet support, yet nobody has answered me thus far.
Thanks in advance for any help you can provide.
Cheers.

yes it is illegal
The IGA (Interactive Gambling Act) makes it an offence to publish or broadcast in Australia an advertisement for an interactive gambling service. The prohibition extends to all forms of media, both electronic and non-electronic, including advertising via the Internet, broadcast services, print media, billboards and hoardings, subject to certain exceptions. These exceptions include political communication, incidental or accidental advertising, products or services having the same name as an interactive gambling service or anti-gambling advertisements.
A number of gambling services are excluded from the definition of an ‘interactive gambling service’ – for example excluded wagering and excluded lottery services. The advertising ban does not apply to such excluded services.
The prohibition does not extend to advertisements published in overseas media, such as magazines that are published overseas, or websites that are aimed at non-Australian audiences.

It is what I expected to hear, but because I’ve seen quite a few sites hosted in Australia, seemingly owned by Australians, I thought that something may have changed.

Are there any restrictions concerning registered place of affiliate?
I think I would be able to do this business for casinos located e.g. in Gibraltar if I were an Australian.September 13, 2009 at 7:01 pm #803959AnonymousInactiveas long as you where not useing com.au name and hosting it in australia you would be fine

Saw your email in the Centrebet Admin on Friday but didn’t have a chance to get to it until today. Apologies for the delay.
I’ll follow up with you there, but just to confirm, Mak445 is correct. Centrebet does not accept Australian casino or poker players, and this is pretty much the standard across all the Australian programs that I am aware of.

I was pretty sure that was the case, but thanks for clarifying.
