Is being a casino affiliate considered illegal?

    Hello everybody,

    This is my very first post here on the forum and thank anyone in advance for reading it and for answering my question should they be able to do so.

    I have been a casino affiliate for many years but, I just moved to the south of Portugal.

    I explained to a friend of mine who is Portuguese how it is I make money.

    And, he said it might be considered illegal. In Portugal that could easily mean an arrest and all funds to be taken from me.

    Until now I am not able to find proof that it IS illegal nor did I find proof that it is perfectly fine to do so.

    Online gambling is illegal in Portugal.

    Is being an affiliate too?

    This kind of worries me.

    Especially since my income I get from it is considered extremely high compared to the people of Portugal…

    If anyone knows, or if anyone here is Portuguese, could you please let me know what you know?

    Unfortunately I don’t know the specifc answer for this – My advice is to speak to a lawyer in Portugal or speak to one of your affiliate program’s country managers as they will advuice and help you. Someone like Everest will have experts in this area.

    On the whole there is always a solution so even if it proves a bit “dodgy” there are solutions afterall their are many affiliates in many jurisdictions where the law isn’t clear from Germany/Netherlands to a number of Scandinavian countries

    Hi,

    I have been writing something about legal issues about online gambling in Europe. And I found, that it is messy problem because of Europe Union.

    There was a similar problem in Italy, in 2003 called Gambelli Case. The State prosecuted Stanley co.´s affiliate in Italy, because accepting bets in Italy was (is?) reserved to the state.

    Gambelli (affiliate ) won this case, because there is article about free trade between states etc. in EU law.
    I am from Czech rep. where online gambling is illegal too and know many cases, inculding well-known Bet and Win Comp. where courts did not prosecuted companies till now.

    In the text of a law published in Italy last May 5 2009 (can not remember the reference, sorry …), were lifted sanctions against players who play on foreign gambling sites and those who advertise such products.
    The Italian Government has drafted this law to comply with EU laws.
    First, players and webmasters took heavy sanctions (fines and arrests…)
    These sites, however, must licensed in EU.

    If I can find references to this law, I will publish this text here! Sorry guys…
