    I live in one of the two states where gambling is illegal.

    According to xxhttp://www.gambling-law-us.com/State-Laws/Hawaii/, promoting gambling in my state in the first degree is a class C Felony whereas the second degree is a misdemeanor (second section regarding promotion: 712-1221).

    Does that mean I’m pretty much screwed for wanting to become an affiliate since I’d obviously need to promote casinos through my website?

    Any thoughts?

    Guys, gambling has been illegal or partially legal or whatever mix of stuff for always in various states.

    This is not federal law, the United Sates has no law about internet gambling as of yet.

    Make sure you pay attention to the internet applicable section. Gambling laws are diverse and confusing.

    The fact that internet gambling itself is illegal does not affect advertising. Advertising falls in the US under the free speech law.

    The only state that has a law now that threatens advertising is Washington.

    Do not target people who live in paces where gambling online is illegal. Carry a disclaimer. Make it visible.

    Of course I am not a lawyer and what I have to say may be utter nonsense and for your entertainment only.

    Since this has been brought up in a few threads now…about how there is no federal law banning online gambling, but there are some state laws…and looking at the chart that Dom referenced…I’m wondering if any affiliates living in one of the states where online gambling is expressly prohibited have consulted with a lawyer, or know of any cases effecting an online gambler or an affiliate marketer?

    These are the states where online gambling is illegal:
    Illinois
    Indiana
    Louisiana
    Nevada
    Oregon
    South Dakota
    Washington (effective June 7)
    Wisconsin

    Interesting that most of these states have land-based casinos.

    Thanks for that link. I live in Florida, but when i visit that site and read up on the state’s laws, its hard to understand exactly whats legal and whats not. If i contact my state representative, will he be able to tell me more accurately about teh state’s laws? Im mainly concenred about affiliating.

    IMO, I would think it’d be best to get legal counseling on the matter. They would be able to be more clear on the gray areas and answer your questions/concerns regarding the laws your state has to abide by.
