    Hi,

    I hope someone with experience in domainselling would please contact me.

    About 8 months ago i purchased www.(pokerroom)(xxx).com and was just about to start the development of the site, when I realized that a pokerroom had opened www.(xxx)(pokerroom).com – I contacted the poker room to hear if they are interested in purchasing the domain name, and they requested a price.
    I have no idea how much to charge for the domain, so I hope someone with domain selling experience will please PM me, and have a look at the domain names.

    Not the answer you’ll want to hear, but there is no formula. Its all down to the perceived worth by the purchaser. The fact you contacted them devalues that slightly as they know you want to sell so they are in the driving seat to a certain extent.

    Difficult to know what to ask without knowing the exact name, but assuming the XXX is a second dictionary word, my guess would be go for $500 and see what they come back with.

    I would either start with a high price x,xxx + or ask them to make an offer, and indicate you have plans for an informational site otherwise.

    Thanks guys – pretty much what I thought…

    I have put the price tag on medium x.xxx and we will see what happens. Not really looking to sell the domain….plan to develop it myself…

    Depending on how similar they are (i dunno how generic the ‘xxx’ is), the fact you approached them first and offered to sell it to them may be enough evidence that you registered the domain in bad faith and they could win a UDRP proceeding against you.

    Generally it’s a bad idea to infringe on people’s trademarks and then try to sell it to them :)

    Only a lawyer could really answer if you made a stupid move, depending on how you phrased the email.

    We owned the domain before they decided to start a poker room. So basically not our problem. AND it is very difficult to claim the right to a domain unless you own a registered trademark…most companies don’t. You cannot just register a domain and a company and claim right to all similar domain names – even though a lot of people seem to think so :)

    btw don’t think they will buy the domain. Pretty much what i expected, the price is steep, but we don’t really want to part with the domain.

    It depends on what you consider similar. xxxword and wordxxx where xxx is another word might not be considered similar its subjective. But say yahoo.com and yawhoo.com those might be too similar.

    Establishing yourself as a business using a certain name DOES give you certain rights that those who come after you dont have with regards to operating with that name. Also its not necessary to have a trademark on file in order to claim ownership/copyright of a name etc. again its a matter of establishment.

    Not looking to get into a pissing match, but that is a very common misconception you have. :) axl and I are correct here.

    You absolutely 100% do not have to own a registered trademark. If you register a domain similiar to someone else’s…depending how similar and offer to sell it to them, that’s a great way to prove you registered the name in bad faith. It depends how similar it is, how generic the name is, how you phrased the offer, etc.

    It’s different if you really did register it before they did, though…that wasn’t made clear in the original post.

    Also, a common thing is when you register a domain that’s a typo of another company’s and they approach you, you should not offer to sell it to them right upfront. That is how so many people get nailed registering a domain in bad faith.

    I think we pretty much agree here. An established business being approached by someone who has registered a similar name might be able to claim the domain through legal actions. But there are a lot of maybe and but’s….But thats a long discussion and ‘bad faith’ is one of the primary elements :)
    That being said, we registered the domain 6-8 months ago. And browsing through our unused domains I stumbled upon this new pokersite. Therefore we offered the domain name to them, and also pointed out that the domain was purchased before they launched their site. We also pointed out that we would begin the development of the site december 1st. (a few pages has been up for months). Our domain is quite safe :)

    Yeah…if you reg’d first of course you’re fine. It’s just not everyone might know about this, and people who accidentally registered TM domains may not know how to handle it.
