Well, its not the domains you would think lol. I recieved a letter from discoveryresources.org’s lawyers demanding i stop using e-discoveryresources.com as its infringinh on thier trademark. Last time i checked that was pretty tough but the last thing i need is a legal battle lol.. anyone with experience in this?

I was sued for $1,000,000 for an online trade mark infringement a couple years ago.

It was in another industry, and I used the keyword in dispute (it was just a keyword) because wordtracker recommended it. I had no idea that it was trademarked, and they sent me no notice. I was just served papers.

Since that experience I search for intellectual rights or just prominent use of a name before I use it, and I go after people using my intellectual property without mercy.

Whether they win or not, they can make your life difficult. Is it worth it?

that doesnt help a bit there lol.. I cant see this one being a serious case. I have to investigate this with a law firm that knows more about domain names that I do. Its not as if I took a name, E-Discovery resources seems way to basic to be trademarked.. yet they only have discovery resources trademarked its a fine line but not shouldnt even be on the paper i think?

After a lengthy talk with a firm specializing in these matters he said it would be nearly impossible to protect the common name of discoveryresources as it is not actually trademarked as well as a ton of other reasons. To compose a letter is $750 flat fee including all correspondence there after if I so choose that route. Also I can file locally against them in response to the letter but he does not think that is worth the costs.

So got some decisions to make on using it or switching to my ediscoveryconsultants domain.

Last thing i want to do is let it linger, its a lot more to defend an ICANN request than it is to send a letter

Ill think about it for a few days as i was given (10) lol

Id like to just call these people and tell them what i think

No no, I didn’t mean don’t send the letter, send it and then wait what happens before you worry about doing something with the domain.

well after many talkes and research into this these people are full of shit, and I could file locally and make them travel here with no chances of them recovering attourney fee’s witha declaratory suite.

Here is my open response to them along with the orig letter

Very nice post but I can’t open the document without joining.

Looks like you got this matter firmly in hand :)

Of course this is merely the babbling of a clueless joker and not to be construed as a proper comment regarding a legal situation. :hattip:
