The history on this one is that I have a balance of about $450 that PKR owes me as an affiliate but won’t pay me because they have a policy not to pay US affiliates until $1,000 is owed (btw this is some new, unwritten policy).
Here’s my messages with them:
Quote:Quote
I find what you’re telling me hard to believe.1. First, I can’t just push PKR harder and suddenly get revenues up to $1000 anytime soon. Even if I devoted my sites to PKR entirely and did not include any other poker brands it would take over a year if it is even possible to reach your payment marker.
2. Second, I signed up with PKR in good faith and certainly with the understanding that I would be paid for promoting the brand. There was no $1,000 payment limit specified in the affiliate agreement at the time and I don’t think there is one now
3. Third, not paying me money owed is stealing pure and simple. I haven’t violated any agreement between myself and PKR and yet PKR refuses to pay me. How as an affiliate manager can you possibly be OK with that?
4. Fourth, what affiliate would associate themselves or increase placement on a brand that is actively showing a willingness to not pay?I will spread the worth about how PKR is doing business, but I hope that someone @ PKR comes to their senses about this ridiculous policy.

Subject: RE: HELP!Hi Kelly,
I have just looked back and we advised you in March, that we are unable to process your payment until you reach $1000 in commission.
Unfortunately even if you did close your account, we couldn’t process your balance to you.
Perhaps you could push PKR a little harder for one month to boast your revenues up to $1000?

May 5, 2011 at 11:31 pm #816034yuhongMemberThank you for letting us know about this. I find that the response to just “push harder” is ridiculous. As an affiliate from the USA, I will make sure that I don’t promote PKR until their terms are more reasonable.
Once again, it amazes me how affiliate programs can just change their terms of condition, or close completely, on a whim and cheat affiliates out of their hard working money. It definately pays to stick with the tried and true affiliate programs! Live Casino Partners has been one of the best for me for years. This would never happen with their affiliate program!
Thanks again!

We would like to clarify the situation. We pay all our affiliates via their PKR accounts each month. As PKR has never accepted USA players, it is not possible for US based affiliates to hold a PKR account so we have to pay via wire transfer. Due to the time and cost involved we wire the commission when it exceeds $1000. This has been the policy since the company launched back in 2006. We have always ensured that we email each US affiliate that we accept, individually to explain this to them and give them the opportunity to bail out if they do not feel that they want to work with us on those terms. We only accept a handful of US affiliates for this reason.

Each US Affiliate that have been accepted in our system, would have received the below email:

“Many thanks for your recent application to become an affiliate with PKR, due to repercussions of the Unlawful Internet Gambling Enforcement Act in the US it is very difficult for us to pay US based affiliates at this time.

So we are limiting the amount of US affiliates we accept into the PKR affiliate program at this time – however we feel that you would be a very successful affiliate and so have approved you as a PKR affiliate.

– We will pay you via wire transfer each time your commission exceeds $1000 because of the time and cost involved with processing wire transfers.

Please feel free to contact me with any queries or requirements you may have…I look forward to working with you.”

I hope that makes sense, feel free to email us at if we can help in any way to get your commission to the $1000 mark sooner.

I’m going to attach the actual copied text of the actual emails I received from the affiliate program. In none of them was $1000 payout limit for US players mentioned until I specifically asked about it in *2010*. I understand that there is a cost for sending a wire, but you aren’t offering a $25 or even $50 fee to get at my money you are offering nothing.
Here is my welcome to the affiliate program message I received on 1/27/2007:

Affiliate ManagerHere’s a message from 4/27/2007 where the “closed the affiliate program to US citizens” which didn’t happen.
Quote:Dear Kelly,Due to the Unlawful Internet Gambling Enforcement Act (UIGEA) that was passed by Congress in the fall of 2006, we are not able to process any payments to affiliates based in the US.
For this reason we regret to announce that we will be closing the PKR affiliate program to US citizens with immediate effect.
This decision was not taken lightly as we would have been very happy to have you on board as a PKR affiliate. There would, however, be little sense in going forward while we are unable to guarantee you that your commission payments would be processed.
We will keep your details on record and should the situation change we will be happy to re-approve you as a PKR affiliate.
Future emails from PKR until 2010 just had small payment information for money that was going into my PKR account (but that I could not withdrawal). On 4/28/2010 I wrote to ask about getting the money:
Quote:I’m promoting PKR from inside the USA and am therefore unable to use the normal cashout process from the PKR cardroom to get affiliate income. What do I need to do to cash this money out?My affiliate and pkr username is kmslogic
Thanks
Kelly
Then on 4/29/2010 they responded:
Quote:When you were approved as an affiliate you will have been sent an email with the following*
Many thanks for your recent application to become an affiliate with PKR, due to repercussions of the Unlawful Internet Gambling Enforcement Act in the US it is very difficult for us to pay US based affiliates at this time.
*
So we are limiting the amount of US affiliates we accept into the PKR affiliate program at this time – however we feel that you would be a very successful affiliate and so have approved you as a PKR affiliate.
*
-****** We will pay you via wire transfer each time your commission exceeds $1000 because of the time and cost involved with processing wire transfers.
*
Please feel free to contact me with any queries or requirements you may have…I look forward to working with you.
*
You currently have $226.21 in your account, so in order to process a withdrawal we will have to wait until that exceeds $1000.
Kind regards

Affiliate Manager
So in short I didn’t hear anything about $1000 until I asked this question and they responded “accepting me into the affiliate program” even though I was clearly already in the affiliate program because I had already earned over $200 between 2007 and 2010.
Even if this weren’t the case the policy of holding money until $1,000 is ridiculous and indefensible. At a minimum provide a cashout with a service charge to cover the wire. Party Poker somehow manages to wire me affiliate fees every month without imploding and they didn’t serve the US market after the UIGEA went into effect.
May 6, 2011 at 1:40 pm #816044kellyj994MemberHi Kelly,
The first email you were sent in 2007 is an automated email approving you into the program, a seperate manual email would of been sent to you also advising you of the $1000 limit.
If you take a look at the 2010 email, the first line in the email is “When you were approved as an affiliate you will have been sent an email with the following” so you can see this has been our approach from day 1. Unfortunately this employee has left PKR so I cannot retrive her old emails.
However to try and bring this to a resolution I have spoken with our finance team for you and the cost of processing a wire to you would be $50, if you are happy to deduct this from your total we can send the funds across to you.
You have my email address so if you are happy with this, please let me know and we will get the ball rolling.
Kind regards,
Harry Barber
affiliates.pkr.comMay 6, 2011 at 2:20 pm #816045gamblogMemberThat will be just fine, and all I would expect. Your current system ensures that all US affiliates will lose an average of $500.00 by dealing with you (between $0 and $999.99 whenever you and they eventually part ways)–I hope you add the ability for them to cash out even if you charge a wire fee and then I don’t have a problem with PKR at all.
May 6, 2011 at 2:41 pm #816046kellyj994MemberI would have to disagree, as I mentioned earlier we only approve a handful of US affiliates that we feel can generate enough revenue to over come the issues of sending a bank wire. I can however appreciate your situation as you have never reached that barrier since 2007. I’ve just sent across the details I need from you and we will organise the bank wire for you.
All the best
Harry Barber
