The Kahnawake Gaming Commission’s application for inclusion on the UK ‘White List’ has been rejected.
Where does this leave UK affiliates who have been promoting casinos such as Captain Cook’s?
Do we have to remove all related content or do you have plans to be regulated in the EEA?
Technically speaking, you should have stopped promoting them back at the start of September when the 2005 Gambling Act came in. It’s up to you, if you think the risk is worth taking then carry on and hope nothing happens, or the casino you’re promoting moves to a white listed area for its licensing. Having spoken to the people who do the advertising enforcement, they would contact you to stop first if an issue was made, and the company you’re promoting would be first in line for legal action, then possibly yourself.
However, this would mean people would need to be making a complaint against you first, and so far I’ve not seen any examples of how this white list has been policed. Personally I decided to avoid pushing non-listed sites back in August – but if you have one that’s earning you a crust, I understand the dilemma.

From September onwards, I put a disclaimer on the relevant pages to the effect that they were licensed by KGC (and therefore not applicable to UK visitors) and that the application was probably going to be accepted – at which point I’d remove the disclaimer.
Now, I’m up the creek!
I’ll have to remove all the content (or re-direct it) fairly quickly, unless I get some indication that they intend to move jurisdictions…

Casino Rewards is currently in the process of going through applications to be licensed through Malta in order to be regulated through the EEA.
At this stage I don’t have a timeline as to how long this takes, but as soon as I hear any further information I will pass it on.This is an interesting discussion.
What UK list are you referring to though, Fortune Palace?Kahnawake is a careless licensing jurisdiction whose accreditation does not mean anything. They cooperate with a several highly reputed gambling operators also, but their accreditation alone is no factor of trust and security at all.

I think you’re confused somewhere down the line. UK players are still able to play at sites licensed outside the white list, so they don’t have to stop playing at KGC licensed sites. It’s just that us advertisers (and that includes anyone who adds an affiliate link) based in the UK are not allowed to promote them.

DioBach, you’re right – I was getting it back to front. I’m now in the process of removing all relevant ads and siphoning all related traffic to a separate page that will explain the situation to visitors.
Once it’s resolved, I’ll re-instate the original content.
