    It’s official, the EU Court of Justice decided that it is contrary to the free EU trade to make European gaming operators illegal to take bets from other member’s state.

    What it means for gambling affiliates targeting the European market:
    All countries in Europe will not take the route the US took. No banning of internet gaming will happen !!!!

    Ah there it is – I lost this thread but I found it again eventually :)

    Anyway, having read the ruling, two things occur: firstly they stated that moral judgements were a potential justification of laws like the Italian one. Secondly, the reason appears to be because Italy have granted licences to some, excluding others, so it appears t me to be a ruling on anti-competitiveness more than anything.

    It’s still good, but the ruling doesn’t really cover countries who don’t grant licences for online betting. At least that’s how I read it. Although, most probably do :D

    Placanica ruling NEWS
    The egaming industry has welcomed today’s judgement from the European Court of Justice (ECJ) in the Placanica case which has suggested the European state gambling monopolies are violating fundamental principles of freedom to provide services.

    The ECJ ruling states that the attempts by the Italian authorities in 2004 to attempt to charge three individuals – Mr Placanica, Mr Palazzese and Mr Soricchio – with criminal charges for collecting bets on behalf of Stanley International without the required police authorisation was “contrary to community law”.

    Today’s judgement went on to say that though a licensing system “may constitute an efficient mechanism enabling the control of operators, the blanket exclusion of companies from tender procedures for the award of licenses goes beyond what is necessary in order to achieve the objective of preventing operators active in the betting and gaming sector from being involved in criminal or fraudulent activities”.

    Peter Nylander, chief executive of Unibet, said once again the ECJ had questioned the gambling monopolies. “This will accelerate the break-up of the existing monopolies in Europe,” he added. “The time for the monopolies is over.”

    Another industry figure said: “It makes a change for something to go in favour of the industry for once.”

    I think it is excellent news, best we have had in some time.

    As some of you know, i live in EU. I forwared this to our lawyers, their first impression is that this is a good news, but each member state can sue you ass and then you can apply to superior court for second judgement. You can still be held prison while you apply to superior court.

    Things are going the right way. EU will most likely find a way to make online gambling legal and regulated in all member states.

    BTW. Did “Stanley International” had a gaming license in EU ?
